CUMBERLAND — A Mount Savage man stopped for use of a cell phone while driving Tuesday was then charged with drunken driving, according to the Allegany County Sheriff’s Office.
The stop was made at an unspecified location in the Cumberland area when a deputy saw a driver using a cell phone.
The deputy then determined the driver had been consuming alcohol and appeared to be intoxicated. An open container of alcohol was discovered in the vehicle along with several unopened containers of alcohol, police said.
Joseph Malloy, 36, was charged with driving while under the influence, driving while impaired, violating a license restriction and using a handheld device while operating a motor vehicle.
Police said the arrest was made during Distracted Driving Awareness Month as designated by the National Safety Council.
