Mineral board revotes ban on smoking

KEYSER, W.Va. — The Mineral County Board of Health recently revoted on a vote that was taken during a special meeting in September in order to come into compliance with the Open Governmental Meetings Act, according to A.J. Root, administrator with the Mineral County Health De-partment.  

A Jan. 2 extension for business to come into compliance with smoking ban regulations was placed on the agenda for the Dec. 9 meeting of the Board of Health and the board voted on it to make it official, said Root.

 During the special meeting, the board voted on the extension but the agenda didn’t list any action items and instead it solely listed a discussion with the county commissioners, according to Root. A special meeting called for a specific purpose cannot include any other discussion or action, according to the open meetings law.

The vote taken during the special meeting was made after County Commissioner Jerry Whisner asked for an exemption for private clubs to give them time to adapt to the smoking ban.

The smoking ban went into effect countywide on Oct. 1, but a Jan. 2 extension was granted so businesses could prepare to come into compliance with the regulations, according to Root.

The amendment to the Mineral County Clean Indoor Air Regulation of 2013 eliminates indoor smoking and requires businesses to have outdoor smoking areas. The outdoor designated smoking areas are required to be located 15 feet or more from any outside entrance, exit or ventilation units of any buildings or areas where smoking is prohibited, according to the regulations.
