2007 case back in Garrett County Circuit Court

— OAKLAND — A Garrett County man was placed on probation as a result of a 2007 sex offense case presented in Garrett County Circuit Court.

William Russell Lyons, 29, pleaded guilty to second-degree rape, sodomy and second-degree assault. He was then sentenced to a total of 30 years in the Maryland Division of Correction.

All of that sentence was suspended, except for a little more than seven years, which he has already served. He is on probation and must register as a sex offender.

Lyons, who resided in Friendsville in 2007, was charged by officers with the Garrett Bureau of Investigation in March 2007 after deputies and troopers responded to White Rock Road for a domestic violence call.

Investigators later learned that Lyons had committed rape and sodomy of his girlfriend and had assaulted a child in the residence during a series of events the previous two days.

In 2007, he initially pleaded guilty but that conviction was vacated after he filed a petition for post-conviction relief, successfully challenging whether the pleas were made knowingly and understandingly.  

The State’s Attorney’s Office explained, “This plea results in Mr. Lyons having the same record of convictions and his being supervised as a sexual offender without the victim and family members having to relive the trauma of events that occurred over eight years ago.

“Based on Mr. Lyons’ history and the time he had served, the state believes he would have soon been eligible for parole and released in any event. Very specific conditions of supervision were attached at the local level.”
