Augusta, Burlington men sentenced in federal court

One case involves transfer of short-barreled shotgun

MARTINSBURG, W.Va. — An Augusta man and a Burlington man were among seven people sentenced Monday in U.S. District Court in Martinsburg by Judge Gina Groh.

Ryan Lambert Barnes, 31, of Augusta was sentenced to five years’ probation, according to U.S. Attorney William Ihlenfeld II. Barnes pleaded guilty Nov. 27 to knowing transfer of a short-barreled shotgun on Aug. 30, 2011, in Hampshire County.

Barnes transferred a Relevation shotgun with no serial number to a confidential informant for $100. Conversation during the transaction revealed that Barnes knew the shotgun was too short and not registered.

This case was prosecuted by Assistant U.S. Attorney Paul Camilletti and investigated by the Bureau of Alcohol, Tobacco, Firearms & Explosives and the Hampshire County Sheriff’s Department.

Donald Nelson Davey II, 34, of Burlington was sentenced to 37 months’ imprisonment to be followed by three years of supervised release. Davey pleaded guilty Oct. 10 to felon in possession of ammunition on April 9.

Davey, having previously been convicted of possession of counterfeit securities in the Northern District of West Virginia District Court, knowingly possessed 20 Remington pellet shells and one Remington 20-gauge slug.  

He was remanded to the custody of the U.S. Marshal pending designation to a federal institution.

The case was prosecuted by Camilletti and investigated by the U.S. Probation Office and the Bureau of Alcohol, Tobacco, Firearms & Explosives.
